Protect
Yourself
A vendor who
controls the contract also controls the bottom line. That's an accepted fact in
nearly all industries. Buy a car or a set of tires or a kitchen appliance or take
your car to the dealer for service and you'll be handed a document to sign (a contract).
Vendors know that contracts offer protection. What's true for a tire company or
an appliance retailer is just as true for a construction contractor.
You need the
same protection. And the best way to get that protection is with a contract you
draft yourself. Most experienced construction contractors (and every lawyer) will
agree: To protect yourself, work under a contract you drafted.
Failure to get a signed contract that complies with Pennsylvania law
is a misdemeanor
if the job is for $2000 or less. If for over $2,000, failure to get a valid signed
contract is a third degree felony. Don't risk an investigation by Pennsylvania's
Bureau of Consumer Protection or a call from your local district attorney or the
Pennsylvania Attorney General.
Obviously, you've got a major advantage when negotiating for a job if you're good
at drafting construction contracts:
- Your printed contract looks highly professional, and
- Contract revisions are quick and easy (if required), and
- You're confident the contract complies with state law, and
- You can deliver a contract almost instantly by email, and
- You deliver the contract in a format that can't be easily changed.
